Conditions / Reason for Refusal: 01 The fencing, gate and brick arch, by reason of its appearance, materials and scale is materially harmful to the character and appearance of the property and to South Anston Conservation Area. The proposal is therefore contrary to Local Plan Policies CS23 ‘Valuing the Historic Environment’, CS28 ‘Sustainable Development’ and SP41 ‘Conservation Areas’, SP55 ‘Design Principles’, as well as the Council’s SPD ‘Householder Design Guide’ and the guidance in the National Planning Policy Framework and the National Planning Practice Guidance. 02 The fencing, gate and brick arch, due to its height, materials and location adjacent to neighbouring dwelling no. 27a High Street would harm the outlook of the residents of No. 27a High Street, materially harming their residential amenity. The proposal is thereby contrary to the NPPF, policies CS28 ‘Sustainable Design’ and SP55 ‘Design Principles’ of the Local Plan and the adopted Supplementary Planning Document - ‘Householder Design Guide’. Informative Enforcement action has been authorised requiring the removal of the fence, gate and brick arch, within a compliance period of 3 months. Appropriate action should be taken to secure the removal/reduction in height of the fence panels, posts, brick arch and gate to avoid formal enforcement action. POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. Whilst discussions during the determination of the application have identified a possible acceptable alternative to this proposal, the applicant has been unwilling to amend the scheme. This was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
