The proposed structure, by virtue of its method of construction, mobility and size, is not considered to meet the definitions of a caravan under Section 29 of the Caravan Sites and Control of Development Act 1960, as amended, and Section 13(1) and (2) of the Caravan Sites Act 1968, as amended. As such, the erection and siting of the proposed structure, is operational development as defined in Section 55(1) of the Town and Country Planning Act 1990, and the structure would constitute a building as defined in Section 336 of the same Act.

It has not been demonstrated that the proposed structure would be dependent on, and ancillary to, the main dwellinghouse. It is considered, based on relevant case law and by matter of fact and degree, that the proposed structure would not be consistent with the lawful use of the land as a single planning unit and would give rise to a material change of use.
