Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans (as set out below) Drawing numbers (Location Plan, Proposed Site Plans, Floor plans)(received 06/08/25). Reason To define the permission and for the avoidance of doubt. Hours of use 03 The use hereby permitted shall only be open between the hours of 0800-1930 Monday to Friday 0800-1630 Saturday and Sunday. In addition • Parent and Baby or Private Hire for teaching will be limited in capacity to a maximum of 12 people per session during weekdays (Monday to Fridays). • Individual One to One teaching/lessons shall only take place after 1500 hours on weekdays (Monday to Fridays). • Group lessons (eg swim school lessons) shall only take place after 1700 hours on weekdays (Monday to Fridays). • Children’s parties and other private hire sessions shall only take place during Weekends (Saturday and Sundays as well as Bank Holidays). Reason In order to reduce the demand for shared parking spaces in the vicinity of the site during peak working periods of nearby business units. Operational development/Management Plan 04 The use shall only take place in accordance with the approved Operational Development Management Plan (ref Super Swimmers 10.11.25). Reason In order to reduce the demand for shared parking spaces in the vicinity of the site during peak working periods of nearby business units. 05 Before the proposed development is brought into use, a Travel Plan shall have been submitted to and approved by the Local Planning Authority. The plan shall include clear and unambiguous objectives, modal split targets together with a programme of implementation, monitoring, validation and regular review and improvement. The Local Planning Authority shall be informed of and give prior approval in writing to any subsequent improvements or modifications to the Travel Plan following submission of progress performance reports as time tabled in the monitoring programme. Reason In order to promote sustainable transport choices. 06 The ancillary café use shall only be for the use of customers visiting the site and shall not operate independently outside of the opening hours of the swimming pool facility. Reason The primary use of the building shall be as an F2(d) Swimming Pool use. Yorkshire Water/RMBC Drainage 07 The site shall be developed with separate systems of drainage for foul and surface water on and off site. The separate systems should extend to the points of discharge to be agreed. Reason In the interest of satisfactory and sustainable drainage. 08 No piped discharge of surface water from the application site shall take place until works to provide a satisfactory outfall, other than the existing local public sewerage, for surface water have been completed in accordance with details submitted to and approved by the Local Planning Authority. Reason To ensure that the site is properly drained and in order to prevent overloading, surface water is not discharged to the public sewer network. 09 No development shall take place until works have been carried out to provide adequate facilities for the disposal and treatment of filter backwash and swimming pool water, in accordance with details to be submitted to and approved by the local planning authority. Reason To ensure that the development can be properly drained without damage to the local water environment. Removal of Permitted Development Rights 10 The change of use shall be used an swimming pool use only (Use Class F2(d)) and not for any other wider purposes (including any other community or recreational uses) in Class F2. Reason This application has only considered the specific use proposed as the site may not be suitable for an open F2 Use Class. Informatives Environment Agency Environmental permit – advice to applicant The Environmental Permitting (England and Wales) Regulations 2016 require a permit or exemption to be obtained for any activities which will take place: • on or within 8 metres of a main river (16 metres if tidal) • on or within 8 metres of a flood defence structure or culverted main river (16 metres if tidal) • on or within 16 metres of a sea defence • involving quarrying or excavation within 16 metres of any main river, flood defence (including a remote defence) or culvert • in the floodplain of a main river if the activity could affect flood flow or storage and potential impacts are not controlled by a planning permission The applicant should not assume that a permit will automatically be forthcoming once planning permission has been granted, and we advise them to consult with us at the earliest opportunity. The submitted 'Flood Risk Assessment' 45086-001 prepared by Eastwood, dated June 2020 is acceptable. In summary, the report states that Foul water will discharge to public foul water sewer. A watercourse exists near to the site - surface water will discharge to this subject to approval by appropriate governing body. 2.) Development of the site should take place with separate systems for foul and surface water drainage. The separate systems should extend to the points of discharge to be agreed. a.) The developer is required to consult with Yorkshire Water's Trade Effluent team (telephone 03451 242424) on any proposal to discharge trade effluent to the public sewer network. b.) Foul water from kitchens and/or food preparation areas of any restaurants and/or canteens etc. must pass through a fat and grease trap of adequate design before any discharge to the public sewer network. 3.) Under the provisions of section 111 of the Water Industry Act 1991 it is unlawful to pass into any public sewer (or into any drain or private sewer communicating with the public sewer network) any items likely to cause damage to the public sewer network interfere with the free flow of its contents or affect the treatment and disposal of its contents. Amongst other things this includes fat, oil, nappies, bandages, syringes, medicines, sanitary towels and incontinence pants. Contravention of the provisions of section 111 is a criminal offence. 4.) If provision for emptying any swimming pool is to be made (e.g. for maintenance or repair etc.) then this must not be discharged to a public surface water sewer. To prevent overloading of the public foul or combined sewer network, any such discharge must be at a controlled rate that does not exceed 2 litres per second. For such discharges from public and/or commercial etc. swimming pools, a trade effluent consent - that may be conditional and place a restriction on the rate of discharge to public sewer - may be required. The developer is advised to contact Yorkshire Water's Industrial Waste Section (telephone 0345 1242424) about any such proposal. 5.) It is noted from the submitted planning application that surface water is proposed to be drained to watercourse - Yorkshire Water fully endorse this means of surface water disposal. a.) The developer should note that further restrictions on surface water disposal from the site may be imposed by other parties. The developer is strongly advised to seek advice/comments from the Environment Agency/Land Drainage Authority/Internal Drainage Board with regard to surface water disposal from the site. The landowners’ consent will be required for the construction of a new outfall structure. b.) As surface water from the site is not proposed to discharge to the public sewer network, no assessment of the capacity of the public sewers to receive surface water has been undertaken. Should the surface water disposal proposals change, further consultation with Yorkshire Water will be required. POSITIVE AND PROACTIVE STATEMENT The applicant and the Local Planning Authority engaged in pre application discussions to consider the development before the submission of the planning application. The application was further amended during the application process. It was considered to be in accordance with the principles of the National Planning Policy Framework.
