Conditions / Reason for Refusal: 01 The Council considers that visibility at the access of Mount Terrace with Brampton Road and is severely restricted in both directions, such that the driver of a vehicle leaving the access, must emerge into the highway before an acceptable degree of visibility is available. The proposal would be severely detrimental to road safety contrary to NPPF paragraph 115 of the NPPF. 02 The existing vehicular access to the site is considered to be unsuitable in view of its restricted width at the junction of Mount Terrace and Brampton Road, such that two vehicles would not be able to pass each other safely. This restricted width potentially results in vehicles reversing either into Brampton Road or along Mount Terrace (until a suitable turning facility is provided), with both manoeuvres resulting in the potential to increase vehicular and vehicular/pedestrian conflict. 03 The windows within the rear elevations of the proposed dwellings would directly overlook the rear gardens of neighbouring properties on Woodfield Road which would be materially harfuly totheir residential amenity contrary to Core Strategy Policy CS28 – Sustainable Design and Policy SP12 ‘Development on Residential Gardens’ and advice contained in the NPPF. 04 As a result of the siting of the proposed dwellings, limited site area and proximity to the boundaries of the site, the proposed dwellings would fail to provide sufficient amenity to future residents in terms of outlook from habitable room windows and lack of private amenity space contrary to advice contained in the South Yorkshire Residential Design Gude and the NPPF. 05 The applicant has failed to provide information that demonstrates no net loss of biodiversity at the site before and after development has taken place. As such, the proposal is contrary to the requirements of Local Plan Policy SP33 ‘Conserving and Enhancing the Natural Environment’ and requirements set out in the Environment Act 2021. POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. It is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
