Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved location plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans • Location Plan GV-5R-SLP-01D • Proposed Site Layout GV-5R-SLP-500-01D • Proposed Internal Plan E:GV-5R-IP-01 • Proposed Cycle Shelter GUL42-SS Reason To define the permission and for the avoidance of doubt. 03 This permission shall be valid for a temporary period of 7 calendar years only, from the point of first use. At the end of that period (unless further permission has been granted by the Local Planning Authority to continue the use as a SEND School) the use hereby permitted shall cease, unless the use is otherwise in accordance with an extant planning permission. Reason In accordance with the submitted application 04 The use hereby permitted shall operate between the hours of 07:00 until 21:00 Mon – Fri other than up to 21 days per year for special events, open days and similar school activity days whereby the site is permitted to open on weekends and/or beyond the stipulated hours Reason In the interests of the amenities of the occupiers of nearby dwellings and in accordance with Local Plan Policies. 05 The development shall be completed in accordance with the approved electric vehicle charging details shown on the approved site layout plan prior to the development being brought into use, and retained in perpetuity. Reason In the interests of sustainable development and air quality in accordance with the Local Plan and the NPPF. 06 The mitigation measures identified in the Air Quality Mitigation Statement ref. DC4917-AR2v3, Dragonfly Consulting dated April 2025 shall be implemented. Reason In the interests of and air quality and in accordance with Local Plan policies. 07 The fencing around the external play area shall be 2.4m high eco profile mesh net fencing. Reason In the interest of visual amenity 08 Before the proposed development is brought into use, the submitted Travel Plan shall be implemented and shall remain in place throughout the life of the development. The Local Planning Authority shall be informed of and give prior approval in writing to any subsequent improvements or modifications to the Travel Plan following submission of progress performance reports as time tabled in the programme of implementation. Reason In order to promote sustainable transport choices. 09 The approved cycle shelter shall be provided on site prior to the development being brought into use. Reason In order to promote sustainable transport choices. 10 Before the development is brought into use the car parking area, pedestrian crossings, footways and drop off areas shown on the approved site layout plan shall be provided, marked out and thereafter maintained for the approved use. Reason To ensure the provision of satisfactory parking and manoeuvring areas within the site in the interests of road safety. 11 There shall be no piped discharge of surface water from the development prior to the completion of an approved surface water drainage scheme; and, the building shall not be occupied for the use hereby approved, prior to completion of a scheme of approved foul drainage works. For the avoidance of doubt, the surface water drainage scheme shall include construction of the part(s) of the site to be used for the parking of vehicles with a) a permeable surface and associated water retention/collection drainage, and/or b) an impermeable surface with water collected and taken to a separately constructed water retention / discharge system within the site. Reason To ensure that the development can be properly drained in accordance with Local Plan policies 12 If subsoil/topsoil is required to be imported to site for remedial works/areas of soft landscaping, then these soils will need to be tested at a rate and frequency to be agreed with the Local Planning Authority to ensure they are free from contamination. The details of which will need to be presented in the format of a Validation Report. Reason To ensure the safe occupation of the site in accordance with Policy SP54 of the Rotherham Local Plan and paragraph numbers 187, 196 and 197 of the National Planning Policy Framework. 13 If during development works unexpected significant contamination is encountered, the Local Planning Authority shall be notified in writing immediately. Any requirements for remedial works shall be submitted to and approved in writing by the Local Authority. Reasons To ensure the safe occupation of the site in accordance with Policy SP54 of the Rotherham Local Plan and paragraph numbers 187, 196 and 197 of the National Planning Policy Framework. 14 Notwithstanding the details shown on the approved plans, a detailed scheme of soft landscaping, including tree and shrub planting shall be submitted to and approved in writing by the Local Planning Authority within 3 months of first occupation of the development hereby approved. The approved landscaping scheme shall thereafter be carried out within the first available planting season following first use (a planting season being between October and March the following year, in a period free of ground frost or significantly wet / waterlogged ground conditions. Any trees / planting which are removed, die or become severely damaged or diseased within the first five years following planting shall be replaced with a tree or shrub of the same or similar species within the next season. Reason To ensure that there is a well laid out scheme of healthy trees and shrubs in the interests of amenity and in accordance with Local Plan policies. Informatives 01 This development is not subject to the statutory Biodiversity Gain Plan condition because of the declaration on the application form that the development was exempt (because the impact on habitat is de-minimis). POSITIVE AND PROACTIVE STATEMENT Whilst the applicant did not enter into any pre application discussions with the Local Planning Authority, the proposals were in accordance with the principles of the National Planning Policy Framework and did not require any alterations or modification.
