The Council considers that due to the siting of the building, its three storey design and the design and position of windows results in a substantial loss of privacy to the properties on Shelley Road and the private garden areas of these properties and other surrounding properties. This causes substantial harm and material loss of amenity to existing residents in conflict with policies CS28 ‘Sustainable Design’ and SP55 ‘Design Principles’ and advice within the NPPF.

The Council further considers that this development comprising of a full three storey scale represents overdevelopment of a backland residential site which has a limited area and irregular shape and results in a cramped form of development that is at visually at odds with the predominantly low density street layout of the surroundings which are mainly two storey semi-detached properties. The building causes harm to the surrounding residential character and conflicts with policies CS28 ‘Sustainable Design’, SP11 ‘Development in Residential Areas’ and SP55 ‘Design Principles’.
POSITIVE AND PROACTIVE STATEMENT
The applicant and the Local Planning Authority engaged in pre application discussions to consider the development before the submission of the planning application though the proposed development was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
