Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved location plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans Location Plan 669/02/02 – Proposed Plans Reason To define the permission and for the avoidance of doubt. 03 The cooking odour extraction plant shall only be operated between the hours of 11:00 and 22:00 Mondays to Sundays. Reason To safeguard the amenities of the occupiers of nearby properties. 04 The maximum sound power levels (LwA) of the extractor fan shall not exceed those specified in Table 4.1 of the Noise Impact Assessment, prepared by Noise Solutions Limited, dated 25th April 2025 (Ref: NIA-12004-25-12248-v1Rotherham). Reason To safeguard the amenities of the occupiers of nearby properties. 05 Prior to the extraction system being brought into use 3 in-duct attenuators shall be installed to the atmosphere side of the cooking odour extraction plant and shall each be capable of achieving the sound reduction criteria as detailed in Table 4.2 of the Noise Impact Assessment, prepared by Noise Solutions Limited, dated 25th April 2025 (Ref: NIA-12004-25-12248-v1Rotherham). It shall thereafter be maintained and retained in perpetuity. Reason To safeguard the amenities of the occupiers of nearby properties. 06 The extract fan unit shall be suitably lagged with an acoustic jacket so as to achieve a noise reduction of 9dB in relation to noise from the casing breakout levels as specified under Section 4.2 of the Noise Impact Assessment, prepared by Noise Solutions Limited, dated 25th April 2025 (Ref: NIA-12004-25-12248-v1Rotherham) before being brought into use. It shall thereafter be maintained and retained in perpetuity. Reason To safeguard the amenities of the occupiers of nearby properties. 07 Anti-vibration mounts and flexible connectors shall be installed prior to the system being brought into use, in order to minimise the transfer of vibration between the extract fan and the ductwork as specified under Section 4.2 of the Noise Impact Assessment, prepared by Noise Solutions Limited, dated 25th April 2025 (Ref: NIA-12004-25-12248-v1Rotherham). It shall thereafter be maintained and retained in perpetuity. Reason To safeguard the amenities of the occupiers of nearby properties. 08 All cooking fumes shall be exhausted from the building via an extraction system. The system shall as a minimum include grease filtration, an Electrostatic Precipitator (ESP) and an ozone system to reduce cooking odours. Extraction shall terminate at a minimum of 1m above the eaves of the building and at a minimum velocity of 10m/s. The extraction/filtration system shall be operated and maintained in accordance with the manufacturer’s specifications. The system shall be operated effectively during cooking. Reason To safeguard the amenities of the occupiers of nearby properties. Positive and Proactive Statement Whilst the applicant did not enter into any pre application discussions with the Local Planning Authority, the proposals were in accordance with the principles of the National Planning Policy Framework and did not require any alterations or modification.
