The development hereby permitted shall be commenced before the expiration of three years from the date of this permission.
Reason
In order to comply with the requirements of the Town and Country Planning Act 1990.

The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications as shown on the approved plans (as set out below)
(Drawing numbers location plan PP-13771490v1, revised site plan 140-002 Rev A, elevations 140-003, Floor Plans 140-004)(received 21/02/25 and 13/03/25).
Reason
To define the permission and for the avoidance of doubt.
Hours of Operation

The use hereby approved shall only operate between the following hours:
• 09:00 and 17:30 Mondays to Saturdays.
• No working on Sundays or Bank Holidays.
Reason
To safeguard the amenities of the occupiers of nearby properties in accordance with
RMBC Policy SP52 and part 15 of the NPPF.
Highways

Before the development is brought into use, the western access shall be
signed or marked ‘In Only’ and the eastern access signed or marked ‘Out Only’ in
accordance with details to be submitted to and approved by the Local Planning
Authority. The accesses shall thereafter be used as a one way system only.
Reason
In the interests of highway safety.

Before the development is brought into use, that part of the site to be used by vehicles shall be properly constructed with either
a/ a permeable surface and associated water retention/collection drainage, or
b/ an impermeable surface with water collected and taken to a separately constructed water retention / discharge system within the site.
All to the satisfaction of the Local Planning Authority and shall thereafter be maintained in a working condition.
Reason
To ensure that surface water can adequately be drained and to encourage drivers to make use of the parking spaces and to ensure that the use of the land for this purpose will not give rise to the deposit of mud and other extraneous material on the public highway in the interests of the adequate drainage of the site and road safety.

Before the development is brought into use the car parking area shown on the submitted plan (revised site plan 140-002 Rev A) shall be provided, marked out and thereafter maintained for car parking.

Environmental Health

Tyre removal and refitting activities shall only take place within the ‘Tyre Removal/Fitting’ building as detailed on the ‘Proposed Site Plan’ (Drawing No: 140-002 Rev A), and the ‘Proposed Floor Plans’ (Drawing No: 140-004) provided in support of this application. The operation shall take place in accordance with the agreed details as specified within the Design and Access Statement (Ref Design Concept – Noise, Peel Architecture).

To safeguard the amenities of the occupiers of nearby properties in accordance with
RMBC Policy SP52 and part 15 of the NPPF.
Informatives
The applicant is reminded to operate the site in accordance with the approved Design and Access Statement as indicated in condition 07. For clarity this includes the following technical details:
• The 1No. compressor shall have a maximum Sound Power Level of 65dBA LWA and the 1No. tyre fitting machine shall have a maximum Sound Power Level of 75dBA LWA.
• All internal walls to the ‘Tyre Removal/Fitting’ building as detailed on the ‘Proposed Site Plan’ (Drawing No: 140-002) shall be insulated as specified in Section 2.2 (Design Concept – Noise) of the Design and Access Statement, and as detailed in the ‘Proposed Floor Plans’ (Drawing No: 140-004) provided in support of this application.
• Doors to the ‘Tyre Removal/Fitting’ building as detailed on the ‘Proposed Site Plan’ (Drawing No: 140-002) shall be installed as specified in Section 2.2 (Design Concept – Noise) of the Design and Access Statement, and as detailed in the ‘Proposed Floor Plans’ (Drawing No: 140-004) provided in support of this application.
• Except for access and egress, doors to the ‘Tyre Removal/Fitting’ building as detailed on the ‘Proposed Site Plan’ (Drawing No: 140-002), and the ‘Proposed Floor Plans’ (Drawing No: 140-004) provided in support of this application shall be kept closed whilst machinery is in operation.
• Wheels shall be removed and refitted to vehicles using manual methods only. Power tools and pneumatic tools shall only be used within the ‘Tyre Removal/Fitting’ building as detailed on the ‘Proposed Site Plan’ (Drawing No: 140-002), and the ‘Proposed Floor Plans’ (Drawing No: 140-004) provided in support of this application.
POSITIVE AND PROACTIVE STATEMENT
Whilst the applicant did not enter into any formal pre application discussions with the Local Planning Authority, the proposals were in accordance with the principles of the National Planning Policy Framework and following clarifications and additional information did not require any further alterations or modification.
