Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications as shown on the approved plans (as set out below) (Drawing numbers location plan, site plan RDB/ROC/SR/01/C, Office Floor plan RDB/ROC/SR/06, Workshop Floorplan RDB/ROC/SR/07, Office elevations RDB/ROC/SR/02, fencing details RDB/ROC/SR/04, new pedestrian access details RDB/ROC/SR/01 Rev C)(received 08/11/24, 27/01/25). Reason To define the permission and for the avoidance of doubt. 03 The site shall be used for F1a (educational and training facility only) and F2b (community facility) and no other uses within the wider F1 and F2 Use Classes. Reason The site is not considered suitable for an open F1 or F2 Use Class. Hours of Operation 04 • The use hereby approved shall only operate between the following hours: For class F1 usage, between the hours of 07:30 and 17:00 Mondays to Fridays. • For class F2 usage, between the hours of 16:00 and 20:00 Mondays to Fridays, between the hours of 10:00 and 18:00 on Saturdays, and between the hours of 11:00 and 16:00 on Sundays. Reason To safeguard the amenities of the occupiers of nearby properties in accordance with RMBC Policy SP52 and part 15 of the NPPF. Highways 05 The new pedestrian entrance onto Sycamore Road shown on approved plan RDB/ROC/SR/01 Rev C shall be implemented prior to the building being brought into use and retained throughout the lifetime of the development. Reason In order to promote sustainable transport choices. Electric Vehicle Charging Points 06 Before the building is brought into use a scheme detailing the dedicated facilities that will be provided for charging electric vehicles and other ultra-low emission vehicles shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall meet at least the following minimum standard for numbers and power output: • One Standard Electric Vehicle Charging Point providing a continuous supply of at least 16A (3.5kW) for at least 20% of the development. Parking spaces that are to be provided with charging points shall not be brought into use until the charging points are installed and operational. Charging points installed shall be retained thereafter. Reason In the interest of supporting and encouraging low emission vehicles, in the interest of air quality enhancement, to comply with the aims and objectives Chapters 2, 9 and 15 of the National Planning Policy Framework. Local Labour Agreement 07 Prior to the operational use of the land/building(s) hereby approved, a Local Labour Agreement outlining measures to be taken to employ local workers for the operational phase of the development shall be submitted to and approved in writing by the Local Planning Authority. The scope of the Agreement shall be agreed in writing prior to submission of the formal document. The development shall thereafter be carried out in accordance with the approved details. Reason To improve skills in all of Rotherham’s communities through the promotion of access to training, education and local employment opportunities, in accordance with Policy CS10 ‘Improving Skills and Employment Opportunities’. POSITIVE AND PROACTIVE STATEMENT Whilst the applicant did not enter into any formal pre application discussions with the Local Planning Authority, the proposals were in accordance with the principles of the National Planning Policy Framework and following clarifications and additional information did not require any further alterations or modification.
