That a lawful Development Certificate be REFUSED in respect of a proposed single storey side extension & porch to front at 1 Cotswold Crescent, Whiston, S60 4AU for the following reason:
Based on the evidence submitted it is considered that the proposed side extension if constructed in accordance with the submitted plans would not be lawful. The proposed new extension would project beyond the existing front elevation of the dwellinghouse. Therefore, the side extension is not in compliance with the criteria outlined within Schedule 2, Part 1, Class A of the Town and Country Planning (General Permitted Development) Order 2015, as amended. The porch however, would fall within the requirements outlined within Part 1, Class D of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) and as such is concluded to be permitted development.
