The permission hereby granted shall relate to the area shown outlined in red on the approved location plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans:

The materials to be used in the construction of the external surfaces of the development hereby permitted shall be in accordance with the details provided in the submitted application form. The development shall thereafter be carried out in accordance with these details.

Within three months of the decision date the 2m high close boarded fence identified in Proposed Plans (2021_05_BR2REVC) shall be erected along the boundary with no. 66 Selby Lane and no. 3 The Downings. The combined boundary wall and fence shall thereafter be retained and maintained.

To provide an effective screen in the interests of amenity

Within 28 days of the date of this decision, an Arboricultural Method Statement shall be submitted to the Local Planning Authority detailing the method of removal of the damaged Ash Tree. The tree shall be removed within the first planting season following approval of the Arboricultural Method Statement.

To ensure that the existing tree is removed to allow for a replacement tree.

Within the first available planting season following the removal of the existing Ash tree, a Tilia cordata (small leaved lime tree), stock size- heavy standard, shall be planted in the same position. Should the tree die, be removed or damaged, or fail to thrive within a period of 5 years from completion of planting it shall be replaced within the next planting season. Assessment of requirements for replacement planting shall be carried out on an annual basis in September of each year and any defective work or materials discovered shall be rectified before 31st December of that year.

To ensure the appropriate replacement of the existing protected tree in the interests of visual amenity.
POSITIVE AND PROACTIVE STATEMENT
During the determination of the application, the Local Planning Authority worked with the applicant to consider what amendments were necessary to make the scheme acceptable. The applicant agreed to amend the scheme so that it was in accordance with the principles of the National Planning Policy Framework.

Prosecution action has been authorised under S210 (1)© of the TCPA 1990 for the damage caused to the Ash tree protected by Tree Preservation Order No. 9 (2018), on those responsible for the offence.
