The development hereby permitted shall be commenced before the expiration of three years from the date of this permission.
Reason
In order to comply with the requirements of the Town and Country Planning Act 1990.

The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications as shown on the approved plans (as set out below)

The use hereby approved shall only operate between the following hours:
09:00 – 23:00 Monday to Sunday (including Bank Holidays).

To safeguard the amenities of the occupiers of nearby properties in accordance
with RMBC Policy SP52 and part 15 of the NPPF.
Noise

• The cooking odour extraction system shall not operate outside the hours of 09:00hrs and 23:00hrs as specified in section 4.2 of the Noise Impact Assessment by Infinity Acoustics (Project Ref No: A192RN).
• Only a ‘System Air AR Sileo 450 E4 Axial Fan’ shall be installed as part of the cooking odour extraction system as specified in section 4.3 of the Noise Impact Assessment by Infinity Acoustics (Project Ref No: A192RN).
• A ‘Vent Direct CP03-CA-0550 Silencer’ shall be installed between the fan and external ductwork terminus as specified in section 4.4 of the Noise Impact Assessment by Infinity Acoustics (Project Ref No: A192RN).

Odour
The cooking odour extraction system shall include high level odour control measures in the form of either Fine Filtration or Electrostatic Precipitation (ESP) followed by Carbon Filtration (Carbon Filters rated with 0.2-0.4 second residence time), or Fine Filtration or Electrostatic Precipitation (ESP) followed by a UV Ozone system to achieve the same level of control as the carbon system described above as detailed in section 4.2 of the Kitchen Odour Assessment by NoiseAir Ltd, dated 2nd September 2024 (Report Ref: P7699-R2-V1). The proposed extraction/filtration system shall be operated and maintained in accordance with the manufacturer’s specifications. The system shall be operated effectively during cooking.

POSITIVE AND PROACTIVE STATEMENT
Whilst the applicant did not enter into any pre application discussions with the Local Planning Authority, the proposals were in accordance with the principles of the National Planning Policy Framework and did not require any alterations or modification.
