Conditions / Reason for Refusal: 01 The fencing, by reason of its appearance, materials and scale within this prominent location is materially detrimental to the visual amenities of the street scene and erode the open nature of the area. The proposal is therefore contrary to Local Plan Policies CS28 ‘Sustainable Development’ and SP55 ‘Design Principles’, as well as the Council’s SPD ‘Householder Design Guide’ and the guidance in the National Planning Policy Framework and the National Planning Practice Guidance. Informative Enforcement action has been authorised requiring the removal of the fence along the front boundary, or their reduction in height to a maximum 1m, within a compliance period of 3 months. Appropriate action should be taken to secure the removal/reduction in height of the fence panels, posts and gates to avoid formal enforcement action. POSITIVE AND PROACTIVE STATEMENT The applicant did not enter any pre application discussions with the Local Planning Authority. It is not possible to support a scheme of this nature and no amendments have been identified at this time to make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal. (B) That the Chair and Vice Chair in conjunction with the Director of Planning Service, authorise the service of an Enforcement Notice under Section 172 of the Town and Country Planning Act 1990, on the OWNER / OCCUPIER of, and anyone else having a financial interest in, the land at 3, Lordens Hill, Dinnington, Rotherham, S25 2QE, requiring the removal, or reduction in height to a maximum 1m, of the fence that are on the front boundary with a compliance period of 3 months, and Prosecution action be pursued where appropriate action not taken within relevant timescales.
