Conditions / Reason for Refusal: 01 The permission hereby granted shall relate to the area shown outlined in red on the approved location plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans 004 Rev 01 – Location Plan 003 Rev 01 – Site Plan 002 Rev 01 – Elevations 005 – Floor Plan Reason To define the permission and for the avoidance of doubt. 02 The Ow Do Bar located in the basement (including the covered outdoor seating area) as shown on drawing number 005 shall only be open to patrons between the hours of 12:00-23:00hrs Mondays to Sundays. Reason To safeguard the amenities of the occupiers of nearby properties. 03 No amplified music or audio other than low level background (incidental) music or audio shall be played in the outdoor areas (including the covered outdoor seating area). Developments should have floor levels set higher than the recorded flood level or a minimum of 300mm above proposed ground level. Such signage is controlled by the Town and Country Planning (Control of Advertisements) (England) Regulations 2007 and a separate application for advertisement consent will be required for the sign on the side of the building for RWS. POSITIVE AND PROACTIVE STATEMENT Whilst the applicant did not enter into any pre application discussions with the Local Planning Authority, the proposals were in accordance with the principles of the National Planning Policy Framework and did not require any alterations or modification.
