Conditions / Reason for Refusal: 01 The proposed development will have a negative impact on the long term health of protected trees, through the need to excessively manage their size and shape in order to provide suitable clearance of the building and to provide access to acceptable levels of sunlight. This will lead to the long-term detriment of the site and a permanent loss of public amenity which would be harmful to the character and appearance of the area contrary to Local Plan Policies CS19 ‘Green Infrastructure’, CS20 ‘Biodiversity and Geodiversity and SP12 ’Development on Residential Gardens’. 02 The external garden areas of the development hereby proposed will be overly oppressed by the presence of existing tree canopies. Accordingly, the development would result in an unacceptable level of residential amenity for future occupiers with regards to outdoor amenity space. In this respect the proposal would conflict with paragraph 135 of the NPPF which seeks, amongst other things, to ensure that developments have a high standard of amenity for existing and future users, and also with the South Yorkshire Residential Design Guide which states that private outdoor amenity spaces must endeavour to have sufficient sunlight. POSITIVE AND PROACTIVE STATEMENT Whilst the applicant entered limited pre application discussions with the Local Planning Authority as part of the previous planning application, these identified that the level of development on the site was unclear due to site constraints identified, however it is not possible to support the final scheme as submitted. The application was not considered to be in accordance with the principles of the National Planning Policy Framework of the Local Plan resulting in this refusal.
