Conditions / Reason for Refusal: 01 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans (as set out below) (Drawing numbers location plan 22002_01, floorplans 22002_05 and 22002_06)(received 05 March 2024) Reason To define the permission and for the avoidance of doubt. 02 The occupation of the first residential unit shall only take place after all new external window outlooks have been installed in the positions as agreed on floorplans 22002_05 and 22002_06. Reason In the interests of the amenities and living conditions of the future occupiers of the building. 03 The new first floor windows along the western elevation facing 1 and 7a Church Street shall be obscurely glazed and fitted with glass to a minimum industry standard of Level 3 obscured glazing and be non-openable, unless the part(s) of the window(s) which can be opened are more than 1.7 metres above the floor of the room in which the window is installed. The applicant will be aware that the proposed application RB2024/0330 for a new second floor level and 5no. additional flats is a separate development which has been refused in August 2024 and cannot be implemented. POSITIVE AND PROACTIVE STATEMENT Whilst the applicant did not enter into any pre application discussions with the Local Planning Authority for this development, following clarifications the proposals were in accordance with the principles of the National Planning Policy Framework and did not require any further alterations or modification.
