The development hereby permitted shall be commenced before the expiration of three years from the date of this permission.
Reason
In order to comply with the requirements of the Town and Country Planning Act 1990.

The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans (as set out below)

To define the permission and for the avoidance of doubt.

Within 1 month of the date of this permission, details of the odour abatement used in the extraction system at the premises shall be submitted to the Local Planning Authority, and the approved details shall be implemented within 1 month of their approval. All cooking fumes shall be exhausted from the building via an extraction system which as a minimum shall include fine filtration or ESP followed by carbon filtration (with a 0.4-0.8 second residence time) or fine filtration or ESP followed by UV ozone system to reduce cooking odours as specified in the Odour Control Report by Cater Safe Ltd, dated 2nd April 2024 (Ref: 13585185). Extraction shall terminate at a minimum of 1m above the eaves of the building and at a minimum velocity of 10m/s. The extraction/filtration system shall be operated and maintained in accordance with the manufacturer’s specifications and the details approved in writing with the Local Planning Authority along with the timescale for installation. The system shall be operated effectively during cooking for the lifetime of the development.
Reason:
To safeguard the amenities of the occupiers of nearby properties in accordance with RMBC Policy SP52 and parts 12 & 15 of the NPPF.
Positive and Proactive Statement
The applicant and the Local Planning Authority engaged in pre application discussions to consider the development before the submission of the planning application. The application was submitted on the basis of these discussions. It was considered to be in accordance with the principles of the National Planning Policy Framework.
