Conditions / Reason for Refusal: 01 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans (as set out below) and in accordance with all approved documents. Site Location Plan at scale 1:1250 dated 29/06/2023 Block / Site Plan at scale 1:500 dated 29/06/2023 Drawing number 1 – Proposed Floor Plan dated 18/07/2023 Drawing number 2 – Proposed Elevations dated 18/07/2023 Reason To define the permission and for the avoidance of doubt. 02 Except in case of emergency, no operations shall take place on site other than between the hours of 08:30hrs and 18:00hrs Mondays to Sundays. Reason To safeguard the amenities of the occupiers of nearby properties. 03 The site shall be used for the parking of commercial vehicles and siting of 15no. metal storage containers only and for no other purpose (including any other purpose in Class B8 ‘Storage and Distribution’ of the Schedule to the Town and Country Planning (Use Classes) Order, (or any Order revoking and re-enacting that Order with or without modification). Reason To allow a full assessment of future uses in respect of highway and amenity matters. 04 The shipping containers stored on the site shall not be stacked on top of each other and not exceed a height of 6 metres above the existing ground level of the site. Reason In the interests of the visual amenities of the area. 05 Within 3 months from the date of this decision, a Landscape scheme, showing location and types of landscape treatment, shall be submitted for approval by the Local Planning Authority. The Landscape scheme should be prepared in accordance with RMBC Landscape Design Guide (April 2014) and shall be implemented in the next available planting season after approval and maintained to ensure healthy establishment. Any plants dying, removed or destroyed within five years of planting shall be replaced the following planting season. Reason To ensure that there is a well laid out scheme of healthy trees and shrubs in the interests of amenity and Biodiversity Net Gain. Informatives 01 The granting of this planning permission does not authorise any signage to be erected related to the development. Such signage is controlled by the Town and Country Planning (Control of Advertisements) (England) Regulations 2007 and a separate application for advertisement consent may be required. 02 Please note that condition 5 requires the submission of a landscape scheme for the site, if the scheme is not submitted within the timeframe set out in the condition, the Council will look at taking enforcement action against anyone with an interest in the site for a breach of condition. POSITIVE AND PROACTIVE STATEMENT Whilst the applicant did not enter into any pre application discussions with the Local Planning Authority, the proposals were in accordance with the principles of the National Planning Policy Framework and did not require any alterations or modification.
