Conditions / Reason for Refusal: 01 The submitted Sequential Test fails to consider Rotherham Town Centre which contains a range of available retail units suitable for the proposed use. As such, it is considered that the development is contrary to adopted Local Plan Policies CS12 ‘Managing Change in Rotherham’s Retail and Service Centres and SP11 ‘Development in Residential Areas’ and guidance contained within the Adopted SPD7 ‘Town Centre Uses and Developments’ and guidance contained in the NPPF. 02 The proposed scheme if implemented will result in additional on street car parking on Ferham Road occurring, to the detriment of the free and safe flow of other traffic including the potential obstruction of footways and the additional on street car parking will compromise the operation of the highway, contrary to Policy SP56 ‘Car Parking Layout’ and the NPPF. 03 The council considers that the change of use of part of a residential property to a retail unit would have an unacceptable impact on residential amenity of neighbouring properties in close proximity, due to the comings and goings of customers and increased non residential activity. The proposal is therefore contrary to paragraph 130 of the National Planning Policy Framework and Policy SP11 Development in a Residential Area. POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. There were no discussions during the determination of the application as it is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
