Conditions / Reason for Refusal: 01 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans (as set out below) (Drawing numbers location plan L021151 – 100, site plan L021151 – 101 Rev G, elevations and floorplans 3 unit block L021151 - 104, 4 unit block L021151 - 105, 7 unit block L021151 – 106 Rev A, 8 unit block L021151 - 108, landscaping 3912/1 Rev F, Landscape Management Specification updated 5th September 2023, site levels plan 22034-LE-00-ZZ-DR-C-0003 P01, cross section A-A L021151 – 109, fencing (Weldmesh) L021151 – 201 Rev C, entrance gates L021151 – 319 Rev E)(received 29.06.23, 27.07.23, 05.09.23). Reason To define the permission and for the avoidance of doubt. 02 The materials to be used in the construction of the external surfaces of the development hereby permitted shall be in accordance with the details provided in the submitted application form/shown on drawing nos. elevations and floorplans 3 unit block L021151 - 104, 4 unit block L021151 - 105, 7 unit block L021151 – 106 Rev A, 8 unit block L021151 – 108, fencing (Weldmesh) L021151 – 201 Rev C, entrance gates L021151 – 319 Rev E. The development shall thereafter be carried out in accordance with these details. Reason In order to ensure a satisfactory appearance in the interests of visual amenity and in accordance with Core Strategy Policy CS28 Sustainable Design. 04 Before the development is brought into use the sight lines indicated on Drg No L021151-101 Rev G shall be rendered effective by removing or reducing the height of anything existing on the land between the sight line and the highway which obstructs visibility at any height greater than 900mm above the level of the nearside channel of the adjacent carriageway and the visibility thus provided shall be maintained. Reason In the interests of road safety. 05 Before the development is brought into use, that part of the site to be used by vehicles shall be constructed with either; a/ a permeable surface and associated water retention/collection drainage, or; b/ an impermeable surface with water collected and taken to a separately constructed water retention/discharge system within the site. The area shall thereafter be maintained in a working condition. Reason To ensure that surface water can adequately be drained and that mud and other extraneous material is not deposited on the public highway and that each dwelling can be reached conveniently from the footway in the interests of the adequate drainage of the site, road safety and residential amenity. 06 Before the development is brought into use the car parking area shown on Drg No L021151-101 Rev G shall be provided, marked out and thereafter maintained for car parking. Reason In the interests of road safety. 07 The development shall be completed in accordance with the Travel Plan previously approved under discharge of condition RB2023/0127. Reason In order to promote sustainable transport choices. Drainage 08 The development shall be completed in accordance with the foul, surface water and land drainage systems previously approved under discharge of condition RB2023/0127. Reason To ensure that the site is connected to suitable drainage systems and to ensure that full details thereof are approved by the Local Planning Authority before any works begin and in accordance with Policy CS25 of the Local Plan. Environment Agency 09 The development shall be carried out in accordance with the submitted flood risk assessment by LYNAS Engineers, referenced 22034-LE-ZZ-05-RP-D-0001 and dated 15 July 2022, and the following mitigation measures it details: • Finished floor levels shall be set no lower than 28.35 metres above Ordnance Datum These mitigation measures shall be fully implemented prior to occupation and subsequently in accordance with the scheme’s timing/phasing arrangements. The measures detailed above shall be retained and maintained thereafter throughout the lifetime of the development. Reason To reduce the risk of flooding to the proposed development and future occupants Yorkshire Water 10 The site shall be developed with separate systems of drainage for foul and surface water on and off site. The separate systems should extend to the points of discharge to be agreed. Reason In the interest of satisfactory and sustainable drainage. 11 The development shall be completed in accordance with the foul, surface water and land drainage systems previously approved under discharge of condition RB2023/0127. Reason To ensure that no surface water discharges take place until proper provision has been made for its disposal and in the interest of sustainable drainage. Trees 12 The development shall be completed in accordance with the approved tree protection details previously agreed under discharge of condition RB2023/0127. Reason To ensure appropriate tree protection in the interests of protecting the visual amenity of the area, contributing to the quality and character of Rotherham’s environment, air quality and adapting to and mitigating climate change in accordance with Rotherham’s Core Strategy Policies CS3: Location of New Development, CS19: Green Infrastructure, CS20 Biodiversity and Geodiversity, Policy CS21 Landscape, Policy CS28 Sustainable Design. Electric Vehicle Charging Points 13 The development shall be completed in accordance with the Electric Vehicle Charging Points previously approved under discharge of condition RB2023/0839. Reason In the interest of supporting and encouraging low emission vehicles, in the interest of air quality enhancement, to comply with the aims and objectives Chapters 2, 9 and 15 of the National Planning Policy Framework. 14 The development shall be completed in accordance with the Local Labour Agreement (Construction Phase) previously approved under discharge of condition RB2023/0188. Reason To improve skills in all of Rotherham’s communities through the promotion of access to training, education and local employment opportunities, in accordance with Policy CS10 ‘Improving Skills and Employment Opportunities’ 15 The development shall be completed in accordance with the Local Labour Agreement (Operational Phase) previously approved under discharge of condition RB2023/0188. Reason To improve skills in all of Rotherham’s communities through the promotion of access to training, education and local employment opportunities, in accordance with Policy CS10 ‘Improving Skills and Employment Opportunities’. 16 Landscaping of the site as shown on the approved plans (drawing no. Detailed Landscape Proposals 3912/1 Rev F & Landscape Management Specification Rev 05 September 2023) shall be carried out during the first available planting season after commencement of the development and maintained for the lifetime of the development. Any plants or trees which within a period of 5 years from completion of planting die, are removed or damaged, or that fail to thrive shall be replaced within the next planting season. Assessment of requirements for replacement planting shall be carried out on an annual basis in September of each year and any defective work or materials discovered shall be rectified before 31st December of that year. Reason To ensure that there is a well laid out scheme of healthy trees and shrubs in the interests of amenity and in accordance with the Local Plan. Construction Environmental Management Plan (CEMP) 17 The development shall be completed in accordance with the Construction Environmental Management Plan (CEMP) previously approved under RB2023/0127. Reason To safeguard the amenities of the occupiers of nearby properties in accordance with part 15 of the NPPF and Supplementary Planning Document No.2 Air Quality & Emissions. Gates 18 The gates shown on the approved plan shall only be closed between the hours of 2300 and 0600 and there shall be no deliveries to the units hereby approved between these hours. Reason In order to allow vehicles to use the turning facility and to prevent the obstruction of the pedestrian footway during daytime hours in the interests of highway safety. Informatives Yorkshire Water Water Supply 1.) 2’ Private water main crosses the site. This will need diverting/disconnecting at the developers expense. 2.) A supply can be made available. Positive and Proactive Statement During the determination of the application, the Local Planning Authority worked with the applicant to consider what amendments were necessary to make the scheme acceptable. The applicant agreed to amend the scheme so that it was in accordance with the principles of the National Planning Policy Framework.
