Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990 and to assist in the delivery of development. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans (as set out below) (Proposed Cellar 373-6A) (Received 14/03/2023) (Proposed Ground Floor 373 7d) (Proposed 1st Floor 373 -8c) (Proposed Front & Rear Elevation 373 9c) (Proposed Side Elevations Including Courtyard 373-10c) (Proposed Roof Plan 373 11a) Reason To define the permission and for the avoidance of doubt. 03 No development (except for demolition work) shall take place until details of the materials to be used in the construction of the external surfaces of the development, hereby permitted have been submitted and the details/samples have been approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details/samples. Reason To ensure that appropriate materials are used in the construction of the development in the interests of visual amenity and in accordance with Local Plan policies. 04 Details of on site cycle storage shall be submitted to and approved in writing. The approved details shall be implemented prior to the occupation of the dwellings. Reason In the interests of sustainable development in accordance with the Local Plan and the NPPF 05 The development hereby permitted shall not commence (except for demolition work) until drainage plans for the disposal of surface water and foul sewage have been submitted to and approved by the Local Planning Authority. The scheme shall be implemented in accordance with the approved details before the development is first brought into use. The disposal of surface water by means of soakaways should be considered as the primary method. If this is not practical and there is no watercourse is available as an alternative other sustainable methods should also be explored. If these are found unsuitable, satisfactory evidence will need to be submitted, before a discharge to the public sewerage system is considered. Reason To ensure that the development is provided with a satisfactory means of drainage as well as reduce the risk of creating or exacerbating a flooding problem and to minimise the risk of pollution. Informative Measures to facilitate the provision of gigabit-capable full fibre broadband for the development hereby approved should be carried out, please see attached Informative Note in this respect. POSITIVE AND PROACTIVE STATEMENT During the determination of the application, the Local Planning Authority worked with the applicant to consider what amendments were necessary to make the scheme acceptable. The applicant agreed to amend the scheme so that it was in accordance with the principles of the National Planning Policy Framework.
