Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans (as set out below) Drawing Numbers (Location Plan)(Received 19/10/2022)(Drawing Numbers Existing Plans & Elevations/ Existing Site Plan)(Received 23/09/2022) Drawing numbers (Proposed Plans & Elevations)(Received 31/03/2023)(Drawing Numbers Garage Plans & Elevations Rev A)(Received 10/05/2023). Reason To define the permission and for the avoidance of doubt. 03 No development above ground level shall take place until details of the external materials to be used in its construction have been submitted or samples of the materials left on site, and the details/samples have been approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details/samples. Reason To protect the special character and appearance of the Grade II Listed Building in accordance with Local Plan Policies SP40 Listed Buildings and CS23 ‘Valuing the Historic Environment.’ 04 Details of the doors and windows and their colour treatment shall be submitted to and approved in writing with the Local Planning Authority at a scale of 1:10. All windows and doors shall be either constructed of timber or aluminium. The development should proceed in accordance with the approved details. Reason To protect the special character and appearance of the Grade II Listed Building in accordance with Local Plan Policies SP40 Listed Buildings and CS23 ‘Valuing the Historic Environment.’ 05 Prior to the commencement of development of the wall and gates, detailed plans shall be submitted to the Local Planning Authority at a scale of 1:25 or similar showing the design of the wall and gates. The wall shall be constructed of natural stone and shall be coursed to match the existing boundary wall. The gate piers shall also be constructed of natural stone. The details of the stone samples used for the wall and gate piers shall be submitted for consideration. The development shall proceed in accordance with the approved details. Reason To protect the setting of the Grade II Listed Buildings and to protect the character and appearance of the Ulley Conservation Area. In accordance with policies SP40 Listed Buildings and SP41 Conservation Areas. 06 Prior to the commencement of development (including initial site clearance) the scheme for the protection of existing trees and hedgerows, detailed in the Arboricultural Method Statement, dated 08 February 2023, shall have been approved in writing and been installed on site by the Local Planning Authority. All tree protection methods detailed in the Arboricultural Method Statement, shall not be moved or removed, temporarily or otherwise, until all works including external works have been completed and all equipment, machinery and surplus materials have been removed from the site, unless the prior approval of the Local Planning Authority has first been sought and obtained. Evidence shall be submitted to the Local Planning Authority show that the development is being carried out in accordance with the approved method statement and tree protection plan. This could include a written record of the project arboriculturist site visits and/or a set of photos of the detailed tree protection fencing in place throughout the duration of the development. Reason: To ensure appropriate tree protection in the interests of protecting the visual amenity of the area, contributing to the quality and character of Rotherham’s environment, air quality and adapting to and mitigating climate change in accordance with Rotherham’s Core Strategy Policies CS3: Location of New Development, CS19: Green Infrastructure, CS20 Biodiversity and Geodiversity, Policy CS21 Landscape, Policy CS28 Sustainable Design. Positive and Proactive Statement The applicant and the Local Planning Authority engaged in pre application discussions to consider the development before the submission of the planning application. The application was later amended to address concerns raised by the Local Planning Authority. The amended plans are considered to be in accordance with the principles of the National Planning Policy Framework.
