Reason(s) for Refusal:
The proposed development does not comply with the permitted criteria under The
Town and Country Planning (General Permitted Development) (England) Order
2021 (as amended), Schedule 2, Part 3, Class MA which allows for changes of use
from Class E (commercial, business and service) to a use falling within Class C3
(dwellinghouses) only. The proposed development does not therefore constitute
permitted development.
The Council does not consider that the applicant has submitted sufficient evidence
to demonstrate compliance with the following conditions
© flooding risks in relation to the building,
(d) impacts of noise from commercial premises on the intended occupiers of the
Development, and
(f) the provision of adequate natural light in all habitable rooms of the dwellinghouses.
POSITIVE AND PROACTIVE STATEMENT
The applicant did not enter into any pre application discussions with the Local Planning Authority. Discussions during the determination of the application have identified that it is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
