Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans (as set out below) (Drawing numbers, 02/03/04 Rev A)(received 20/06/2022) (Drawing number, 01/ Rev A/ Rev1 B)(received 23/09/2022) Reason To define the permission and for the avoidance of doubt. 03 The development shall proceed in accordance with the recommendations made in the approved Acoustic Report, dated 06/09/2022. These measures shall include the following: • The internals noise levels shall not exceed those set out in BS8233:2014 with windows closed and mechanical ventilation (MVHR) in operation. • The sound insulation value where dividing elements are between noise producing areas (such as the ground floor retail space and the residential areas of the development) shall be a minimum of DnT,w + Ctr 50dB, or at least -15dB below the highest generated sound level centre band frequencies of concern within the source room, when considered within the dwelling area. • All glazing to all facades of the residential units shall meet a minimum noise reduction value of Rw + Ctr 25dB with the following specification of glazing (or equivalent to meet the same Rw + Ctr values): 4mm float glass – 6mm-20mm wide argon filled airspace – 4mm float glass. • Ventilation provided to residential units shall comprise of a type 4 mechanical ventilation with heat recovery systems (MVHR). The system shall be attenuated such as noise ingress through the vents or produced by the mechanical ventilation unit itself does not exceed the internal noise criteria as set out in BS8233:2014. Reason To safeguard the amenities of the future occupants in accordance with Policies SP52 ‘Pollution Control.’ 04 Prior to first occupation, details of measures to facilitate the provision of gigabit-capable full fibre broadband for the development hereby approved, including a timescale for implementation, shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details. Reason In accordance with Local Plan Policy SP61 ‘Telecommunications’ and Chapter 10 of the NPPF. Informative Please note that planning permission will be required for materal alterations to the exterior of the building. In this case any new windows will need to have a similar appearance to the exisitng windows on the property. If not then planning permission may be required. Positive and Proactive Statement During the determination of the application, the Local Planning Authority worked with the applicant to consider what amendments and additional information was necessary to make the scheme acceptable. The applicant agreed to amend the scheme and provide the additional information requested so that it was in accordance with the principles of the National Planning Policy Framework.
