The car park which has been formed in this Green Belt location does not satisfy any of the exemptions listed in paragraphs 149 and 150 of the National Planning Policy Framework and as such it represents inappropriate development in the Green Belt. No very special circumstances have been demonstrated to overcome the harm caused by the inappropriate development, and other harm caused. Consequently, the proposal is in conflict with adopted Rotherham Local Plan Policies CS4 ‘Green Belt’ and SP2 ‘Development in the Green Belt’, and the National Planning Policy Framework.

Enforcement action has also been authorised requiring the use of the land as a car park ceases with a compliance period of 1 month and the land is restored to a grassed area within 6 months. Appropriate action should be taken as soon as possible to avoid the Council serving a formal Enforcement Notice in this respect.
POSITIVE AND PROACTIVE STATEMENT
The applicant did not enter into any pre application discussions with the Local Planning Authority. There were discussions during the determination of the application as the application is retrospective, but the development / use of land that been carried out cannot be supported as it is not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
(B) Authorise Enforcement Action
That the Chairman and Vice Chairman in conjunction with the Director of Planning Service, authorise the service of an Enforcement Notice under Section 172 of the Town and Country Planning Act 1990, on the owner / occupier of, and anyone else having an interest in, the land at Leger Lakes, Eastfield Lane, Laughton-en-le-Morthen, Rotherham, S25 1 ZY requiring the use of the land as a car park ceases, within a compliance period of 1 month and the land is restored to a grassed area within 6 months, and Prosecution should the appropriate action not be taken.
