The Council considers that no evidence has been submitted from the applicant to demonstrate that increased noise and disturbance to noise sensitive areas at unsociable late night hours would not occur. The relaxation of conditions 04 and 05 is therefore considered to conflict with Local Plan Policy SP52 ‘Pollution Control’ along with SP 11 ‘Development in Residential Areas’ which indicates that the Council will seek to minimise the adverse effects of nuisance, disturbance and pollution associated with development.
POSITIVE AND PROACTIVE STATEMENT
The applicant did not enter into any pre application discussions with the Local Planning Authority. Discussions during the determination of the application have identified that it is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
