The Council considers that the variations to the conditions 02 (approved plans) and 09 (location of jet washing) both individually and collectively intensify the use of the site and extend the approved area of jet washing to an area which is closer to residential properties and increases the capacity of the site. Both the amended layout and the increased area for jet washing facilities result in an increase to the levels of noise, airbourne water particles and general disturbance to sensitive residential areas immediately adjacent to the site, particularly to the north and east. The proposed variations to conditions 02 and 09 is therefore considered to conflict with Local Plan Policy SP52 ‘Pollution Control’ along with SP 11 ‘Development in Residential Areas’ which indicates that the Council will seek to minimise the adverse effects of nuisance, disturbance and pollution associated with development.
POSITIVE AND PROACTIVE STATEMENT
The applicant did not enter into any pre application discussions with the Local Planning Authority. Discussions during the determination of the application have identified that it is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
