Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990 02 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans (as set out below) Drawing nos 201A, 202A,204A,205A,206A,207A received 13 May 2022 and 203B received 21 July 2022. 03 The ground floor of the premises shall be used as a retail store only (Use Class E(a)) and for no other purpose (including any other purpose in Class E of the Schedule to the Town and Country Planning (Use Classes) Order 1987, (or any Order revoking and re-enacting that Order with or without modification). Reason The premises are not considered suitable for general use within the Class quoted for amenity reasons. 04 The use hereby permitted shall only be open to customers or for deliveries between the hours of 0800 – 2200 every day. Reason In the interests of the amenities of the occupiers of nearby dwellings and in accordance with the Local Plan. 05 No new fixed plant shall be installed on the premises without the prior written approval of the Local Planning Authority. Reason To safeguard the amenities of the occupiers of nearby properties in accordance with Local Plan Policy SP52. 06 Prior to their insertion, details of the 5 no. anti-ram bollards shall be submitted to and approved in writing by the Local Planning Authority. Reason In the interests of visual amenity. POSITIVE AND PROACTIVE STATEMENT During the determination of the application, the Local Planning Authority worked with the applicant to consider what amendments were necessary to make the scheme acceptable. The applicant agreed to amend the scheme so that it was in accordance with the principles of the National Planning Policy Framework.
