Conditions / Reason for Refusal: 01 The Council considers that the timber structure to the side of the property represents a poor quality addition to the host property which due to its design location and materials of construction would have a significant detrimental effect on the appearance of the property. Furthermore, it would introduce an alien feature within the street scene and would be materially detrimental to the character of the area. As such it is therefore contrary to Local Plan Policy SP55, the SPD Householder Design Guide and NPPF which seek to ensure high quality developments which contribute in a positive manner to existing buildings. (B) That the Chairman and Vice Chairman in conjunction with the Director of Planning Service, authorise the service of an Enforcement Notice under Section 172 of the Town and Country Planning Act 1990, on the OWNER / OCCUPIER of, and anyone else having an interest in, the land at 70 Broadway East, East Dene requiring the side structure be removed within 3 months. Prosecution action is also authorised should the appropriate steps not be carried out within the specified time periods. INFORMATIVE: 01 Enforcement action has been authorised to ensure that the side structure at 70 Broadway East, East Dene be removed with a compliance period of 3 months and you should take the appropriate steps to avoid formal enforcement action by the Council. POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. Discussions during the determination of the application have identified that it is not possible to support a scheme of this nature, nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
