The proposed hot food takeaway (Use Class Sui Generis) is sited within the defined Town Centre and Primary Shopping Frontage and is less than 200m from Rotherham College. As such, is contrary to the requirements of adopted Local Plan Policies SP19 Development within Town, District and Local Centres, SP 20 Primary Shopping Frontages, SP22 Hot Food Takeaways and Supplementary Planning Document No. 5 Healthy and Equal Communities.

The Council considers that due to lack of a noise impact assessment the potential for nuisance to be caused to the occupiers of nearby residential and commercial premises as a result cooking odour and noise from the proposed external extraction system cannot be assessed. Therefore, it is considered contrary to the NPPF and Local Plan policies CS27 Community Health and Safety sand SP52 Pollution Control.
POSITIVE AND PROACTIVE STATEMENT
The applicant did not enter into any pre application discussions with the Local Planning Authority. It is not possible to support a scheme of this nature and no amendments have been identified at this time to make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
