Conditions / Reason for Refusal: 01 The permission hereby granted shall relate to the area shown outlined in red on the approved plan titled Site Plan and the development shall only take place in accordance with the submitted details and specifications as shown on the approved plans Reference 2067/101 Proposed Final Landform, SK23447/F, SK23448/F, SK23449/F, SK23516B Proposed Landform and Capping Scheme Longitudinal Sections, 23519 Planting Scheme and as described in the original written statement dated 9th November 2005 and Tree Planting Programme of Maintenance Covering the Five Year After Care Period except as shall be otherwise agreed in writing by the Local Planning Authority. Reason To limit the extent of the permission and ensure that the development is carried out in a reasonable manner in the interests of local amenity and the intended afteruse of the land in accordance with the Local Plan. 02 At the end of the 7 year period (11 February 2029), all importation of fill material shall cease and the site shall have been restored and treated in accordance with the details shown on the approved plan and included in the conditions listed below, unless otherwise agreed in writing with the Local Planning Authority. Reason To ensure that the site is restored to a beneficial afteruse within a reasonable period, in accordance with the Local Plan. 03 The finished contours and gradients of the site shall be as shown on the approved plan(s) titled Proposed Final Landform – Oxbow Landfill Aldwarke Rotherham, drawing reference 2067/101 unless otherwise agreed in writing by the Local Planning Authority. Reason To ensure that the site is restored to a form suitable for the intended after use, in accordance with the Local Plan. 04 The types of material to be tipped on site in furtherance of this permission shall be restricted to inert demolition and other solid, dry and inert wastes and non-hazardous refractors and slag wastes. Reason To enable the envisaged afteruse of the site for development purposes to be realised and to prevent underground and surface water pollution in accordance with the Local Plan. 05 Except in case of emergency no operations shall take place on site other than between the hours of 07.00 to 19.00 seven days a week. At times when operations are not permitted work shall be limited to the servicing of plant and other work of an essential or emergency nature. The Local Planning Authority shall be notified at the earliest opportunity of the occurrence of any such emergency and a schedule of essential work shall be provided. Reason In the interests of local amenity, in accordance with the Local Plan. 06 Dust (provision of bowsers) At all times during the carrying out of operations authorised or required under this permission, best practicable means shall be employed to minimise dust. Such measures shall include water bowsers, sprayers whether mobile or fixed, or similar equipment. At such times when due to site conditions the prevention of dust nuisance by these means is considered by the Local Planning Authority in consultation with the site operator to be impracticable, then movements of soils and overburden shall be temporarily curtailed until such times as the site/weather conditions improve such as to permit a resumption. Reason In the interests of local amenity, in accordance with the Local Plan. 07 Noise (silencers to be fitted) All machinery and vehicles employed on the site shall be fitted with effective silencers of a type appropriate to their specification and at all times the noise emitted by vehicles, plant, machinery or otherwise arising from on-site activities, shall be minimised in accordance with the guidance provided in British Standard Code of Practice; 'The Control of Noise on Construction and Open Sites' 2015 no. 227. Reason In the interests of local amenity, in accordance with the Local Plan. 08 Revised scheme of working In the event of the premature cessation of tipping activities on the site for whatever reason then within six months of such cessation a revised scheme of restoration and aftercare shall be submitted by the developer to the Local Planning Authority for approval. Restoration of the site shall thereafter proceed in accordance with the revised scheme and shall be completed within twelve months from the date of approval of the revised scheme, or such other period as may be agreed in writing by the Local Planning Authority. Reason To ensure that in the event of premature cessation of activities the land may still be satisfactorily restored to beneficial use, in accordance with the Local Plan. 09 Pollution (bund walls) Suitable precautions shall be taken by the developer to prevent pollution of any adjoining watercourses or the underlying strata arising from operations on site. Any fixed fuel and oil supply tanks must be surrounded by bund walls of sufficient height so as to contain at least 110% of the storage capacity of the tanks and any associated pipework in the event of a spillage. The floors and walls of the bund must be impervious to water and oil. Reason To ensure that the development does not give rise to problems of pollution to underground strata or adjoining watercourses, in accordance with the Local Plan. 10 Suitable precaution shall be taken to prevent pollution of adjacent watercourses and the underlying strata arising from the development hereby approved. Reason To ensure that the development does not give rise to problems of pollution to underground strata or adjoining watercourses, in accordance with the Local Plan. 11 Effective measures shall be taken to ensure the surface and sub-surface drainage of the tipped areas as operations proceed and on completion of the infilling operation so as to avoid any unsuitability arising within the site, surface ponding, or problems of flooding on adjoining land. Reason To ensure that the development does not give rise to problems of pollution to underground strata or adjoining watercourses, in accordance with the Local Plan. 12 No materials other than soil/soil making materials required for restoration or clean brick rubble or crushed stone required for the formation of the drainage works shall be brought onto the site from sources external to the Aldwarke complex without the prior approval of the Local Planning Authority. Reason In the interests of local amenity and to promote the early restoration of the site in accordance with the Local Plan. 13 Trees and shrubs shall be planted in accordance with the previously approved landscaping plan No. SK 23519 and shall be maintained in accordance with the approved programme of aftercare following the completion of all tipping operations. Reason To ensure that there is a well laid out scheme of healthy trees and shrubs in the interests of amenity, in accordance with the Local Plan. Positive and Proactive Statement Whilst the applicant did not enter into any pre application discussions with the Local Planning Authority, the proposals were in accordance with the principles of the National Planning Policy Framework and subject to the clarifications did not require any alterations or modification.
