Conditions / Reason for Refusal: 01 Within 1 month from the date of this decision the site shall be laid out in accordance with the submitted drawing CS-DP-98-002 rev 1 – Site Layout Plan. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 Motor Vehicle sales shall not exceed the area shaded blue on drawing number CS-DP-98-002 rev 1 – Site Layout Plan. Reason In the interests of highway safety and to ensure the site does not become solely a car sales forecourt which would be in conflict with the site allocation and the Local Plan. 03 Before the development is brought into use, that part of the site to be used by vehicles shall be constructed with either; a/ a permeable surface and associated water retention/collection drainage, or; b/ an impermeable surface with water collected and taken to a separately constructed water retention/discharge system within the site. The area shall thereafter be maintained in a working condition. Reason To ensure that surface water can adequately be drained and to encourage drivers to make use of the parking spaces and to ensure that the use of the land for this purpose will not give rise to the deposit of mud and other extraneous material on the public highway in the interests of the adequate drainage of the site and road safety. 04 Within 1 month from the date of this permission the car parking area shown on the site plan be provided, marked out and thereafter maintained for car parking. Reason In the interests of highway safety. 05 Within 1 month from the date of this permission details of the surface water and all related works necessary to drain the site have been submitted to and approved by the Local Planning Authority. These works shall be carried out and the drainage system shall be operating to the satisfaction of the Local Planning Authority within a timeframe to be agreed with the Local Planning Authority and shall thereafter be maintained. Reason To ensure that the site is connected to suitable drainage systems. 06 Any facilities for the storage of oils, fuels or chemicals shall be sited on impervious bases and surrounded by impervious bund walls. The volume of the bunded compound shall be at least equivalent to the capacity of the tank plus 10%. If there is multiple tankages, the compound shall be at least equivalent to the capacity of the largest tank, vessel or the combined capacity of interconnected tanks or vessels plus 10%. All filling points, associated pipework, vents, gauges, and sight glasses must be located within the bund or have separate secondary containment. The drainage system of the bund shall be sealed with no discharge to any watercourse, land, or underground strata. Associated pipework shall be located above ground and protected from accidental damage. All filling points and tank/vessels overflow pipe outlets shall be detailed to discharge downwards into the bund. Reason To prevent pollution of the water environment. 07 The front boundary wall of the site shall be retained and maintained unless otherwise agreed in writing with the Local Planning Authority. Reason In the interests of the visual amenities of the area and in accordance with the Local Plan. 08 The open storage of materials on the site shall not exceed a height of 3 metres above the general surface of the site. Reason In the interests of the visual amenities of the area and in accordance with the Local Plan. Informatives 01 The granting of this planning permission does not authorise any signage to be erected related to the development. Such signage is controlled by the Town and Country Planning (Control of Advertisements) (England) Regulations 2007 and a separate application for advertisement consent may be required. 02 This will require an Authorised Treatment Facility licence (environmental permit) for End of Life Vehicles (ELVs).
