Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before 22 May 2023. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans (as set out below) Amended site Plan (Received 07/12/2021) Original Plans: Proposed Floor Plans JBA.3824.101.A Amended Proposed Elevations & Streetscene JBA.3824.101.B Landscaping & Boundary detailing JBA.3824.103.A Reason To define the permission and for the avoidance of doubt. 03 Landscaping of the site as shown on the approved plan (drawing no. JBA.3824.103.A) shall be carried out during the first available planting season after commencement of the development. Any plants or trees which within a period of 5 years from completion of planting die, are removed or damaged, or that fail to thrive shall be replaced within the next planting season. Assessment of requirements for replacement planting shall be carried out on an annual basis in September of each year and any defective work or materials discovered shall be rectified before 31st December of that year. Reason To ensure that there is a well laid out scheme of healthy trees and shrubs in the interests of amenity. 04 The dwelling shall be constructed with the following materials: • Anston Premier Range – Regency Buffed Pitched • Sandtoft Calderdale grey tiles • Anthracite Aluminium Windows and Doors • Grey U-PVC cladding to dormer windows Reason In order to ensure a satisfactory appearance in the interests of visual amenity 05 Prior to the occupation of the dwelling the boundary details as shown on the approved plan JBA.3824.103.A shall be installed and thereafter retained/maintained. Reason In the interests of the visual amenity and neighbouring amenity. 06 The development shall be constructed in accordance with the drainage details submitted as part of discharge of condition RB2021/0298. The dwelling shall not be occupied until the approved drainage details are provided. Reason In the interest of on site drainage and to prevent potential surface water flooding. 07 No gates shall be installed on the shared access track with Network Rail, without the prior written approval of the Local Planning Authority. Reason In order to allow emergency access to the adjacent railway line. 08 The access track to the adjoining railway line shall be remain free at all times for Network Rail access, with no storage or construction equipment blocking the access. Reason In order to allow emergency access to the adjacent railway line. 09 Before the development is brought into use, that part of the site to be used by vehicles shall be constructed with either; a/ a permeable surface and associated water retention/collection drainage, or; b/ an impermeable surface with water collected and taken to a separately constructed water retention/discharge system within the site. The area shall thereafter be maintained in a working condition. Reason To ensure that surface water can adequately be drained and that mud and other extraneous material is not deposited on the public highway and that each dwelling can be reached conveniently from the footway in the interests of the adequate drainage of the site, road safety and residential amenity. 10 The junction with Hard Lane shall be constructed as a dropped kerb not radius type crossing. Reason In the interest of highway safety. 11 The proposed access drive shall be constructed at a maximum gradient of 10% (1 in 10). Reason In the interest of highway safety. 12 Prior to the occupation of the dwelling the property shall be provided with the electric charging point and cycle storage area within the basement. Reason To promote sustainable modes of transport. Informatives 01 The Council will seek to ensure that the materials used in the development complement and match the adjoining plots. 02 Security of the railway boundary will need to be maintained at all times. If the works require temporary or permanent alterations to the mutual boundary the applicant must contact Network Rail’s Asset Protection Project Manager.
