Conditions / Reason for Refusal: 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications and as shown on the approved plans (as set out below) (Revised Site Plan 101-D)(Received 13/01/22) (Elevations and Floor Plans 01) (Received 14/04/21) (Drainage Layout) (Received 14/04/21) (Soft Landscaping Scheme) (Received 03/11/21) Reason To define the permission and for the avoidance of doubt. 03 The stable block hereby approved shall be constructed in Olive Green Plastisol sheeting. Reason In the interest of the character of the area and the Green Belt. 04 The surface area of the menage shall hereby approved shall be natural silica sand topped/mixed with a Flexi Ride unless otherwise agreed in writing with the Local Planning Authority. Reason In order to prevent harm to the surrounding environment from the potential leakage of micro plastics in accordance with Policy SP52 ‘Control of Pollution.’ 05 The menage fencing shall include timber base retaining boards of a height of at least 400mm above the level of the flexi ride base and debris netting shall be attached to the fencing. The development shall not be brought into use until the details have been implemented. Reason In the interests of visual amenity and in order to prevent harm to the surrounding environment from the potential leakage of micro plastics. 06 No artificial illumination shall be installed to the arena without the prior approval of the Local Planning Authority. Reason In the interests of local ecology. 07 Landscaping of the site as shown on the approved soft landscaping plan shall be carried out during the first available planting season after commencement of the development. Any plants or trees which within a period of 5 years from completion of planting die, are removed or damaged, or that fail to thrive shall be replaced within the next planting season. Assessment of requirements for replacement planting shall be carried out on an annual basis in September of each year and any defective work or materials discovered shall be rectified before 31st December of that year. Reason To ensure that there is a well laid out scheme of healthy trees and shrubs in the interests of amenity 08 No trees, shrubs or hedges within the site which are shown to be retained on the approved plans shall be felled, uprooted, wilfully damaged or destroyed, cut back in any way or removed without previous written consent of the Local Planning Authority. Any shrubs or hedges removed without consent or dying or being severely damaged or becoming seriously diseased within 5 years from the completion of the development hereby permitted shall be replaced with shrubs or hedge plants or similar species capable of achieving a comparable size unless the Local Planning Authority gives written consent to any variation. 09 Before the development is brought into use the sight lines indicated on the approved site plan shall be rendered effective by removing or reducing the height of anything existing on the land between the sight line and the highway which obstructs visibility at any height greater than 900mm above the level of the nearside channel of the adjacent carriageway and the visibility thus provided shall be maintained. Reason In the interest of highway safety. 10 The development shall be undertaken in accordance with the recommendations and mitigation measures set out in the JJH Consulting Ltd Ecology Report dated September 2019. Reason In the interest of ecology. Informative 01 The access road over a watercourse will require separate approval from the Lead Local Flood Authority (LLFA).
