Conditions / Reason for Refusal: 01 The proposed use would result in an increase in the percentage of takeaways within the town centre to 11%, which is above the threshold of 10% set out in the Local Plan Policy SP22. This would result in a detrimental impact on the economic vitality and viability of the town centre, through shutters being closed throughout the day and clustering of premises which detract from an area's character and function. As such the proposal would conflict with criterion a. of Policy SP22. 02 The hot food takeaway (use class Sui Generis) is located within 800m of three local schools. Accordingly, the proposal conflicts with the requirements of adopted Local Plan policies SP22 ‘Hot Food Takeaways’, CS27 ‘Community Health and Safety’ as well as the adopted Rotherham Supplementary Planning Document No. 5 – Healthy and Equal Communities. 03 The impact of the proposed use and its opening hours would be detrimental to the amenity of neighbouring residents in respect of noise and general disturbance. As such the scheme would be in conflict with policies SP22 ‘Hot Food Takeaways’ and SP52 ‘Pollution Control’ of Rotherham’s adopted Local Plan and paragraph 127 of the National Planning Policy Framework. 04 No details of the extract system associated with the proposed development have been provided, and as such the potential visual impact cannot be fully assessed, contrary to Policy SP55 ‘Design Principles’. POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. They were invited to address the issues raised and to submit further details of the extraction system but declined to do so. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
