Description: Application to undertake works to a tree(s) protected by RMBC TPO No. 11, 2020
Officer Recommendation: GRANTED CONDITIONALLY
Officer Recommendation Date: 12 April 2021
Decision Date: 15 April 2021
Decision Type: GRANTED CONDITIONALLY
Temporary Expiry Date:
Decision Level/Committee: Delegated (Part 2A)
Conditions / Reason for Refusal: Conditions: 1. All tree works shall be carried out in accordance with British Standard 3998: 2010 and shall not exceed the applied for works. 2. A replacement tree is required to maintain the continuity of the protected group. This replacement is to be of the same species in the same location of the tree removed and not less than 10-12cm girth standard nursery stock. It should be planted in the next available planting season (October-March). Informatives: 1. Please note the authorised works should be completed within 2 years of the decision notice otherwise a new application for consent to carry out any non-exempt tree work will be required. 2. Whilst Rotherham Metropolitan Borough Council does not object to the proposed works, for any tree that is owned by a third-party permission must first be sought from the tree owner to enter their land to carry out the works. Without receiving this permission anyone entering the land with the tree on it could be found to be trespassing. 3. Nature conservation protection under UK and EU legislation is irrespective of the planning system and the applicant should therefore ensure that any activity undertaken, regardless of the need for any planning consent, complies with the appropriate wildlife legislation. If any protected species are found on the site then work should halt immediately and an appropriately qualified ecologist should be consulted. For definitive information primary legislative sources should be consulted. Furthermore, vegetation removal should be undertaken outside of the bird breeding season, March to September inclusive. If any clearance work is to be carried out within this period, a nest search by a suitably qualified ecologist should be undertaken immediately preceding the works. If any active nests are present, work which may cause destruction of nests or, disturbance to the resident birds must cease until the young have fledged.
