Conditions / Reason for Refusal: 01 The Council considers that the proposal to erect a bungalow on this site would be detrimental to the setting of the Grade II Listed Building known as No. 1 Greenside by way of enclosing the currently imposing and historically important building, and would not preserve or enhance the character and appearance of the Greasbrough Conservation Area leading to less than substantial harm to both designated heritage assets. Furthermore, the Council is of the opinion that the public benefit of this additional dwelling would not outweigh this less than substantial harm in this instance. As such, the proposed dwelling is contrary to Local Plan Policies CS23 ‘Valuing the Historic Environment’, CS28 ‘Sustainable Design’ SP40 ‘Listed Buildings,’ SP41 ‘Conservation Areas,’ SP46 ‘Conserving and Recording the Historic Environment,’ and SP55 ‘Design Principles’ as well as advice contained in the National Planning Policy Framework. 02 The Council considers that the design and form of the proposed dwelling, in close proximity to the boundaries with Nos. 1 and 1a Greenside, would create an unacceptable sense of enclosure and lead to overbearing impact against the boundary and would materially harm the outlook of residents of No. 1 and No. 1a Greenside. As such, the proposed dwelling is contrary to Local Plan Policy SP55 ‘Design Principles’ as well as guidance in the NPPF. 03 The Council considers that owing to the layout of the property the private amenity space of the proposed dwelling would be directly overlooked by No. 1 Greenside, as well as from the highway at the front of the site which would provide an unacceptable level of private amenity space for the occupants of this property. As such, the proposed dwelling is contrary to Local Plan Policy SP55 ‘Design Principles’ and guidance contained in the NPPF. 04 The applicant has failed to provide sufficient information in the form a Coal Mining Risk Assessment to assess the ground stability of the site. As such, the proposal is contrary to Local Plan Policy SP54 ‘Contaminated and Unstable Land.’ POSITIVE AND PROACTIVE STATEMENT The applicant did not enter into any pre application discussions with the Local Planning Authority. It is considered that it is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
