Conditions / Reason for Refusal: 01 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications as shown on the approved plans (as set out below) (Drawing number JBA.3947.201.A)(received 29 July 2021) Reason To define the permission and for the avoidance of doubt. 02 The development shall be carried out in accordance with the following points: • The garage will be not be constructed within 6 metres of the top of the riverbank (the northern boundary). • The 2 metre portion of the garage closest to the river (the northern boundary) will be sectioned to allow the rear of the garage to be removed if required. This will be achieved by the following points: • The garage to be built on a raft foundation. This allows the wall to be taken down while leaving the foundation in place and providing a hardstanding once the walls are removed. • Movement joints to be installed in the brickwork 2 metres back from rear elevation (the elevation closest to the river) to allow the wall to be removed with the minimum of impact on the remaining structure. • Roof trusses to be set either side of movement joint so roof can be partially taken down without affecting the remaining roof. Remaining structure would need stabilising temporarily, but it could be a neat partial demolition. • 3m x 3m garden shed to rear of garage to be easily dismantled. Reason To ensure that access is preserved for the construction and future maintenance of flood defences along the river. 03 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 03 The materials to be used in the construction of the external surfaces of the development hereby permitted shall match those used in the existing building. Reason In order to ensure a satisfactory appearance in the interests of visual amenity and in accordance with Core Strategy Policy CS28. Positive and Proactive Statement During the determination of the application, the Local Planning Authority worked with the applicant to consider what amendments were necessary to make the scheme acceptable. The applicant agreed to amend the scheme so that it was in accordance with the principles of the National Planning Policy Framework.
