The proposed change of use would have a detrimental impact on the health and wellbeing of the population, by introducing a hot food takeaway within 800m of a college. The proposal would therefore be contrary to the requirements of the Rotherham Supplementary Planning Document No. 5 – Healthy and Equal Communities (adopted June 2020).

The applicant has failed to submit a Sequential Test as required in policies CS12 'Managing Change in Rotherham's Retail and Service Centres’ and SP22 ‘Hot Food Takeaways’ of Rotherham’s adopted Local Plan to assess whether the site is sequentially preferable. The Local Planning Authority have therefore not been furnished with the relevant information to assess whether the site is considered to be sequentially preferable.

The applicant has failed to submit a Noise Impact Assessment and Odour Assessment to assess the impact of the proposed use and its opening hours on the amenity of neighbouring residents in respect of noise, odour and general disturbance. As such the scheme would be in conflict with policies SP11 ‘Development in Residential Areas’ and SP52 ‘Pollution Control’ of Rotherham’s adopted Local Plan and paragraph 127 of the National Planning Policy Framework.
POSITIVE AND PROACTIVE STATEMENT
The applicant did not enter into any pre application discussions with the Local Planning Authority. There were no discussions during the determination of the application as it is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
