The Council considers that the proposed outside seating area (use class E) would be in conflict with the residential surroundings to the south by introducing a use which would lead to unacceptable levels of noise nuisance and general disturbance to local residents, particularly during the evening, in this residential location, and as such the proposal is considered to be contrary to adopted Local Plan Policies SP11 ‘Development in Residential Areas’ and SP52 ‘Pollution Control,’ and paragraph 130(f) of the National Planning Policy Framework.

POSITIVE AND PROACTIVE STATEMENT
The applicant did not enter into any pre application discussions with the Local Planning Authority. Given the nature of the proposal together with its location it is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
