The Council considers that due to the proposed location of the dormer bungalows it is likely that the foundations of plot 1 would have a significant adverse impact on the mature Copper Beech tree situated along the front boundary of the application site recently subject to a Tree Preservation Order. The foundations of the future development are likely to significantly intrude into the Root Protection Area, and this along with issues of increased shade and plant debris to plots 1 and 2 are likely to necessitate regular pruning to mitigate future conflict, thereby reducing the tree’s amenity and increasing the pressure to fell the tree at a later date. The site has limited space for replacement planting in an area visible to the public which would lead to a permanent loss of public amenity and increased built form to the street scene. The proposal is therefore in conflict with Local Plan policies SP32 Green Infrastructure and Landscape and SP33 Conserving and Enhancing the Natural Environment as well as the advice within paragraph 170 of the NPPF.
POSITIVE AND PROACTIVE STATEMENT
The applicant did not enter into any formal pre application discussions with the Local Planning Authority. Discussions during the determination of the application have identified that it is not possible to support a scheme of this nature nor would any amendments make it acceptable. It was not considered to be in accordance with the principles of the National Planning Policy Framework and resulted in this refusal.
