Conditions / Reason for Refusal: Conditions 01 The development hereby permitted shall be commenced before the expiration of three years from the date of this permission. Reason In order to comply with the requirements of the Town and Country Planning Act 1990. 02 The permission hereby granted shall relate to the area shown outlined in red on the approved site plan and the development shall only take place in accordance with the submitted details and specifications as shown on the approved plans (as set out below) ? Existing and Proposed Floor Plan – Dwg No. 54042_67753_8756 Reason To define the permission and for the avoidance of doubt. 03 Prior to commencement of the development, the developer shall assess the existing sound insulation provided between the development site and the adjoining properties (including the flat above), for sound. A report detailing this, and any recommended upgrading of the noise insulation so as to prevent loss of amenity to the adjacent occupiers from activities proposed within the development site, shall be submitted to and approved by the Local Planning Authority. All such recommendations in the approved report shall be undertaken prior to first use of the building. Reason In the interests of the amenities of the occupiers of nearby dwellings and in accordance with the Rotherham Local Plan Policy SP52 ‘Pollution Control’. 04 Within 3 months of the date of this permission, a Noise Management Action Plan shall be submitted to and agreed in writing with the local planning authority. The Noise Management Action Plan shall include measures to ensure that noise from the site is controlled. Reason In the interests of the amenities of the occupiers of nearby dwellings and in accordance with the Rotherham Local Plan Policy SP52 ‘Pollution Control’. 05 Opening hours are restricted to: Mon-Thurs 12:00-22:30hrs, Fri-Sat 12:00-23:00hrs and Sun 12:00-21:00hrs. Deliveries shall be restricted so they cannot take place during local school start and finish times, i.e. between 07:45-9:15hrs, and 14:00- 15:30hrs, and to a maximum of 21:00hrs. Reason In the interests of the amenities of the occupiers of nearby dwellings and in accordance with the Rotherham Local Plan Policy SP52 ‘Pollution Control’. 06 No primary cooking of unprepared food shall be carried out on the premises at any time. Reason In the interests of the amenities of the occupiers of nearby dwellings and in accordance with the Rotherham Local Plan Policy SP52 ‘Pollution Control’. 07 The generation of amplified noise is prohibited on the premises at any time. Reason In the interests of the amenities of the occupiers of nearby dwellings and in accordance with the Rotherham Local Plan Policy SP52 ‘Pollution Control’. 08 There shall be no drinking or seating allowed outdoors and the entrance door shall be kept closed when not in use. Reason In the interests of the amenities of the occupiers of nearby dwellings and in accordance with the Rotherham Local Plan Policy SP52 ‘Pollution Control’. Positive and Proactive Statement During the determination of the application, the Local Planning Authority worked with the applicant to consider what amendments were necessary to make the scheme acceptable. The applicant agreed to amend the scheme so that it was in accordance with the principles of the National Planning Policy Framework.
