Conditions / Reason for Refusal: Consented Works: T2 There are no objections to the proposed works as they are appropriate to the long-term management of the tree and will not have a detrimental impact on the tree or the amenity that it provides. T4 There are no objections to the proposed works as they are appropriate to the long-term management of the tree and will not have a detrimental impact on the tree or the amenity that it provides. Refused Works: T3 The tree is in good condition with no obvious signs of any significant defects. The tree has good vitality with good leaf cover throughout the crown. It is agreed that the tree is now beginning to encroach onto the adjacent dwelling, but this is not a reason to remove an otherwise healthy tree. The tree forms part of a group, and as with other trees that stand within/adjacent to the property has interlinked and formed part of a cohesive border. When investigating the TPO that this tree falls within, it would appear that the TPO was created in response to possible future developments within the area. This giving reason as to why 4 Oaklands is not represented on the plan. As with many new developments, over time it can be expected that they can become overshadowed. The properties will be affected by encroaching branches, light shading, seasonal debris and a perceived risk from falling or ‘dangerous’ trees. This increases the possibility of increased pressure to manage healthy the trees by way of unnecessary pruning or removal. Taking this into consideration, consent to remove it is refused. It is however recognised that some form of tree pruning is required to help alleviate any branch encroachment that may be taking place. T3 Selectively remove secondary and tertiary branches to provide a 3m clearance of the dwelling. However, as the consented work is not similar to the works that have been applied for, a separate application will be required. Conditions: All tree works shall be carried out in accordance with British Standard 3998: 2010 and shall not exceed the description of applied works. Please note the authorised works should be completed within 2 years of the decision notice otherwise a new application for consent to carry out any non-exempt tree work will be required.
